What is unfair competition?

Unfair competition is a set of competitive practices whose nature is contrary to customs and the law. These abusive acts are proven by the accumulation of a loss, a fault and a causal link.


Acts of unfair competition include denigration, imitation, disorganisation and free-riding. The detection of these practices means that sanctions of a civil nature may be imposed. These are mainly the application of damages, the cessation of unfair conduct and ancillary measures.

Providing evidence of unfair competition

Do you suspect that your competitor is acting unfairly? A bailiff's report is the most commonly used technique to prove unfair competition. To do this, you need to ask a judge for authorisation to make use of a court-appointed bailiff.

The procedure under Article 145 of the Code of Civil Procedure aims to establish proof of the unfair competitor's activities in the event of a future lawsuit. The competitor is not notified in advance of the bailiff's arrival, and this procedure is not adversarial in any way.

Setting up a non-competition clause

A non-competition clause can be inserted into the employment contract of each employee. This clause states that the employee may not perform equivalent functions with a competitor or on their own account after the contract has been terminated.
